Key witness does not take stand, has his testimony read in Day 13 of Pinyon Pines trial
Yesterday, the Pinyon Pines triple murder trial jury never entered the courtroom.
The scrutiny of the court fell on a key witness, Jeremy Witt, and whether or not he would be able to take the stand in open court.
Witt, who was co-workers with Cristin Smith at Knott’s Soak City, was set to deliver key testimony which allegedly incriminated both Robert Pape and Smith in the September 2006 murders of Vicki Friedli, Becky Friedli, and John Hayward.
The defense moved to have Witt impeached as a witness on Day 12, while the prosecution argued against. Ultimately, following advisement from his attorney in a separate case, Jeremy Witt evoked the Fifth Amendment yesterday.
If Witt were to take the stand, ongoing cases against him could potentially come up to provide better insight into his credibility as a witness. If he were to be cross-examined about ongoing cases against him, this could lead to self-incrimination; pleading the fifth was the path to avoiding that.
Although Witt will not physically take the stand, his words may still have a major impact on the case; sworn testimony that he provided during a preliminary hearing is being delivered via transcript reading in court today.
Cristin Smith and Robert Pape are both charged with three counts of first-degree murder with special circumstance allegations of taking multiple lives. The 29-year-olds face life in prison without the possibility of parole if convicted in the killings of Becky Friedli, Vicki Friedli, and Jon Hayward.
