Prosecution rests its case in Day 16 of Pinyon Pines murder trial
The jury has returned to the courtroom and the prosecution has rested its case.
Cristin Smith and Robert Pape are both charged with three counts of first-degree murder with special circumstance allegations of taking multiple lives. The 29-year-olds face life in prison without the possibility of parole if convicted of killing Becky Friedli, her mom, Vicki Friedli, and the latter’s boyfriend, Jon Hayward, on the night of Sept. 17, 2006.
Yesterday saw the proceedings proceed sans-jury, as the credibility of Jeremy Witt, a key witness for the prosecution, was examined in an impeachment hearing. The judge indicated two incidents involving Jeremy Witt which may reflect moral turpitude which would invalidate his credibility as a witness.
The first came in the form of a felony conviction for the impersonation of a peace officer in Kentucky, the second involved a violent incident in which he attacked a person at his place of employment at the time, Knott’s Soak City, with a water gun filled with pepper spray and then threatened to kill someone.
Last week, Witt evoked the Fifth amendment before his planned appearance as a witness so as to not incriminate himself in ongoing cases. However, Witt’s testimony from a preliminary hearing was read aloud in court. If Witt were to be impeached, this preliminary hearing testimony would be thrown out.
Today, the prosecution rested its case. However, in the morning, Jeremy Witt has remained a focal point of discussion among the judge, prosecution, and defense. In the morning, the counsels and judge discussed certain stipulations to be read aloud to the jury as well as additional evidence to be potentially ruled inadmissible.
