Sentencing Put On Hold For Convicted Bank Robber
A judge granted a motion to continue the trial for a San Bernardino man convicted of a series of armed bank robberies in the Coachella Valley.
Back in 2009, a jury found Curtis Mosley Jr. guilty of ten counts of bank robbery — four robberies from April to August 2007.
During the trial, there was a question about how some DNA evidence was handled.
When the verdict came down, the public defender used the tampering claim to ask for a new trial.
Judge Dale Wells granted the wish and mosley was out on bail.
But in July 2011, that ruling was reversed by an appeals court and ordered sentencing to be carried out.
The Riverside County District Attorney’s office became frustrated as the judge delayed sentencing time and time again.
Meanwhile, Mosley was a free man.
Earlier this month, Mosley was linked to a bank robbery in Beaumont where shots were fired into the ceiling. No one was hurt.
Mosley and an accomplice, Vincent King, were arrested.
Mosley is now being held on no bail.
But his defense attorney says the DA’s office failed to provide evidence during the first trial that would have been favorable to her client.
She says an anonymous tipster sent more information about mishandled evidence by investigators.
“Since that time, i’ve received additional information regarding the lead detective on the case,” said defense attorney Melanie Roe. “It’s our impression he’s a bad cop and we’re going to flush out the information we’ve received — allegations he has either misappropriated or stolen evidence in an unrelated criminal file.”
A motions hearing is scheduled for March 29 with sentencing set for May 2.
But Roe says, if all goes well for her client, she’s looking to get the case tossed out.
Right after the hearing, Mosley was arraigned on the Beaumont robbery charges and pleaded not guilty.
