PSPD officers won’t face charges in deadly shooting of Marine

The Riverside County District Attorney’s Office announced Thursday that no charges will be filed against two Palm Springs police officers involved in the deadly shooting of a Marine in the downtown parking garage in November of 2012.

According to Spokesman John Hall, the DA’s office concluded no criminal charges will be filed against either officer.

Cpl. Allen DeVillena II was 22-years-old when he was shot and killed by the officers. Police said he was attempting to run over one of the officers as the other officer was hanging from the car while DeVillena tried to drive away.

That’s when police said the officers opened fire.

DeVillena’s family told News Channel 3 and CBS Local 2 that the story was “so inconsistent with [DeVillena’s] behavior”, and that they are a religious family.

The two officers involved were placed on paid administrative leave as the investigation was conducted internally by PSPD and by the Riverside County District Attorney’s Office.
