Lawsuit challenging CV Link dismissed

Riverside County Superior Court Judge James Latting has dismissed a lawsuit challenging the CV Link project according to a Coachella Valley Association of Governments (CVAG) news release.

The lawsuit was filed by former Palm Desert Councilman Jim Ferguson. The lawsuit attempted to call into question three sources of funding for the CV Link, echoing a similar argument made by Rancho Mirage Councilman Dana Hobart in 2015.

“The court sustained the arguments raised by CVAG, the South Coast Air Quality Management District (SCAQMD) and the Riverside County Transportation Commission (RCTC) that Ferguson had failed to raise any valid legal claims in his lawsuit,” read the CVAG news release.

On Feb. 23, the first segment of the CV Link opened to the public. The 2.3 mile stretch runs between Vista China Road in Palm Springs and Ramon Road in Cathedral City.

The CV Link project currently has over $86 million in funding secured.

“Today, Judge Latting reiterated that same notion when he threw out the Hobart/Ferguson lawsuit against CV Link. Hopefully, the end of this ridiculous lawsuit also puts an end to the ridiculous arguments leveled by Councilman Hobart against CV Link,” said Indio Mayor Michael Wilson, Vice Chairman of CVAG. “It’s time to focus on constructing the rest of the CV Link project.”
