Defense rests in Pinyon Pines triple murder trial

The defense rested its case Thursday on day 17 of the Pinyon Pines triple murder trial.

Cristin Smith and Robert Pape are both charged with three counts of first-degree murder with special circumstance allegations of taking multiple lives. The 29-year-olds face life in prison without the possibility of parole if convicted of killing Becky Friedli, her mom, Vicki Friedli, and the latter’s boyfriend, Jon Hayward, on the night of Sept. 17, 2006.

Yesterday, the prosecution rested its case in the afternoon, but, following a trend seen for many days of the Pinyon Pines trial, the credibility of key witness Jeremy Witt was examined. In addition to the discussion of Witt, the counsels and judge consort discussed certain evidence which may be deemed inadmissible, and specific stipulation to be read to the jury.

10 total witnesses took the stand today, including Lee Harvey, a former lead investigator on the case, James Carter, a former acquaintance and neighbor of James Witt who was contacted by a defense investigator, and Investigator Kasperzeyk, the defense investigator who contacted Carter and claimed to have exchanged text messages with someone who was attempting to impersonate Carter.

Just shy of 3 p.m., the defense rested its case. Judge Bernard Schwartz announced to the court that the jury would not come in, as the attorneys will use the day to review jury instructions.

On Tuesday, the prosecution will have the right to present rebuttal evidence. It is estimated that the case will be submitted to the jury either late Tuesday or early Wednesday. Closing arguments could begin as early as late Tuesday.
