No verdict reached on Day 21 of the Pinyon Pines triple murder trial

On the first full day of jury deliberation in the Pinyon Pines triple murder trial, no verdict has been reached.

Yesterday, jury deliberation followed the prosecution’s rebuttal and the tail end of the closing arguments of Jeff Moore, Cristin Smith’s attorney. 10 men and 2 women will select one of three possible outcomes for each charge, two times over, in the Pinyon Pines triple murder trial.

Cristin Smith, 29, and Robert Pape, 30, are both charged with three counts of first-degree murder with special circumstance allegations of taking multiple lives. They face life in prison without the possibility of parole if convicted of killing Becky Friedli, her mom, Vicki Friedli, and the latter’s boyfriend, Jon Hayward, on the night of Sept. 17, 2006.

Day 21 picked up where yesterday left off, with the 12 jurors gathering to deliberate on the potential fates of the two defendants. Yesterday, the jury was instructed that, for each count, the three possible verdicts were as follows: 1) Guilty of first-degree murder, 2) Guilty of second-degree murder, or 3) Not guilty.

Pape & Smith are being tried separately by the same jury.

The defense attorneys’ closing statements, presented on Tuesday and Wednesday, aimed to paint the prosecution’s case against Pape & Smith as being illusory; Jeff Moore, Cristin Smith’s attorney, called the argument one of “smoke and mirrors,” while John Patrick Dolan, Robert Pape’s attorney, referred to it as a concocted “narrative.”

The prosecution’s rebuttal, presented by Riverside County Assistant District Attorney John Aki, looked to sway the jury in the direction of the big picture and away from the over-scrutinization of the case’s minutia.

“If you just take individual pieces of evidence, it’s easy to poke holes.” said Aki yesterday, “Don’t search for the truth in a vacuum…The truth is, Mr. Pape and Mr. Smith were in Pinyon Pines that
night.”
