KESQ Contest Rules

The following set of General Contest Rules is applicable to contents and promotions for Gulf-California Broadcast Company stations. Certain special contests and promotions may be governed by rules established for just that contest or promotion. If there is a conflict between these general rules and rules of a special contest of promotion, the rule of the special contest or promotion shall prevail. These rules apply to contests and promotions aired on these stations or websites: KESQ-TV, KDFX-CA, KUNA-FM-LP, KCWQ-LP, KESQ-AM, KESQ.com, KUNAMUNDO.com, and SuperDesert .com.All on-air contests and promotions specify the prize(s) to be awarded and the method of participation. Participation in the contest or promotion may include random telephone selection, postcard entry, printed entry blanks, telephone call-ins or telephone call-outs, website entry and text entry. When any contest or promotion has a deadline for entry, the deadline will be clearly indicated in on-air promotional announcements and any special written rules. Contests and promotions are open to California residents 18 years of age or older unless otherwise stated for a specific contest or promotion. No purchase is necessary.

Gulf-California Broadcast Company reserves the right to limit participants to (i) one prize per household every 30 days or (ii) in the case of a major prize valued at $500.00 or more, one prize per household every 12 months. Winners are responsible for all federal, state and local taxes, if any. All federal, state and local laws apply. Contests and promotions are void where prohibited or restricted by law.

There are no prize substitutions. Prizes are non-transferable and are not negotiable. Prizes can not be exchanged for cash. Sponsors and Gulf-California Broadcast Company reserve the right to substitute prizes of equal or greater value. Some prizes have restrictions, or expiration dates, and do not include gratuities. Some prizes may be in the form of a single ticket to an event, not a pair of tickets. The winner will be notified at the time of winning if the prize is a single ticket. Dates for concerts, flight departures/arrivals, weekend stays, etc. cannot be changed by the winner. If the winner is not able or chooses not to accept prize “as is,” the winner forfeits his or her prize. The winner is responsible for all costs associated with travel to any venue or event for which a prize is awarded, unless otherwise specified. Movie tickets are an invitation and do not guarantee entry.

Odds of winning are undeterminable and depend on varying telephone response rates, internet access and/or the volume of entities received.

Winners who live in Riverside County, California must pick-up their prize in person at 42-650 Melanie Place, Palm Desert, California 92211 unless arrangements are made in writing. Prizes for winners living outside of Riverside County will be mailed or sent by UPS.

Gulf-California Broadcast Company is not responsible for any prize lost or damaged in shipping. Any prize not picked-up or otherwise claimed within 30 days will be forfeited.

If a concert or other ticketed event has been awarded as a prize and the concert or event is postponed, rained out, cancelled or does not occur for any reason, Gulf-California Broadcast Company will not be responsible for replacing the prize.

Employees and families or anyone living in the same household of employees of Gulf-California Broadcast Company, the (St. Joseph, Missouri) News-Press & Gazette Company and its subsidiaries, and any of our vendors, advisors, advertisers or sponsors or employees of other television and radio stations are not eligible to enter contests and promotions and are not eligible to win prizes. Contests and promotions are not open to owners, officers, employees, consultants or advertising-marketing agencies of or for any television or radio stations, newspapers or cable television franchises in the Palm Springs, California television and radio markets.

All contestants and winners acknowledge as a condition of entry that Gulf-California Broadcast Company, all organizations providing prizes and their participating sponsors have the right to publicize and broadcast his/her name, character, likeness and voice on the air in print advertising.

Winners of a prize with a value of $500.00 or more will be required to complete IRS Form W-9 and will be issued IRS Form 1099 at the time the prize is claimed.

Gulf-California Broadcast Company reserves the right to modify these general rules at any time provided the modified results are announced and made available to the public. Copies of these rules are available at Gulf-California Broadcast Company located at 42-650 Melanie Place, Palm Desert, California 92211. Gulf-California Broadcast Company reserves the right to cancel a contest or promotion at any time prior to the selection of a winner. All decisions of Gulf-California Broadcast Company with regard to the awarding of prizes, the selection of winners and the interpretation of contest or promotion rules shall be final. Each contestant by virtue of entering a station contest or promotion agrees to accept the decision of Gulf-California Broadcast Company as final.

Gulf-California Broadcast Company makes no warranty of any kind with respect to prizes, including, but not limited to, any warranties or merchantability or fitness for a particular purpose.

Gulf-California Broadcast Company hereby expressly disclaims any such warranties.

By participating, all entrants acknowledge and agree they have entered the contest or promotion of their own free will, that the full rules and details of the contest or promotion have been made available to them in writing and they therefore understand and agree that neither

Gulf-California Broadcast Company, all organizations providing prizes, their agencies, and their immediate families, or their agents, affiliates, sponsors, representatives or employees have limited liability with respect to contestants? participation in the contest or promotion or winning a prize and are not liable for any damages arising from acceptance and use of a prize, including liability for personal injury and/or death. By entering into a contest or promotion, participants agree to be bound by these rules and the decision of Gulf-California Broadcast Company, which are binding in all respects.

When claiming a prize, the winner must sign a form (i) acknowledging they have read the rules relating to the specific contest or promotion associated with the prize and (ii) releasing

Gulf-California Broadcast Company and any sponsors of the contest or promotion, and their respective officers, directors, agents, parent companies, subsidiaries and employees, from all claims, demands and or/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that he/she may have, or that he/she may subsequently acquire, as a result of his/her participation in the contest or promotion and/or receipt of the prize.

Gulf-California Broadcast Company is not responsible illegible, late, lost or misdirected entries or for telecommunications malfunction including, but not limited to, any malfunction caused by or through any local or national telephone service provider, cellular telephone provider or internet access provider.

If any of these rules is determined to be unenforceable under an ordinance or statute, all other provisions and rules shall remain in full force and effect.
