CA Supreme Court rules on divorce pension issue
California’s Supreme Court says a divorced man doesn’t have to share his pension increase with his ex.
The San Francisco Chronicle says the court on Monday ruled in the case of Timothy and Julie Green.
Before marriage, the Contra Costa County man was in the Air Force. He became a firefighter but his pension plan allowed him to buy credits based on his prior military service to increase his future pension.
Julie Green argued that she should get a share of the pension increase because he used their joint money to buy the credits.
But the court says the ex-husband earned those credits by military service before marriage. It says the ex-wife should only get back half the money he used to buy them – around $6,700.
